Terms and Policies

Last updated: 30 September 2026

1. About these Terms

1.1

These Terms of Use (“Terms”) govern your access to and use of the Kaimaar website at kaimaar.com and related services (the “Platform”). The Platform is operated by KAIMAAR PTE. LTD. (UEN 202638990C), a company incorporated in Singapore (“Kaimaar”, “we”, “us” or “our”).

1.2

By creating an account, placing an order, listing products or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1.3

These Terms include the following policies, which form part of them:

  • Privacy Policy (kaimaar.com/privacy)
  • Returns and Refunds Policy
  • Prohibited Items Policy
  • Intellectual Property Policy
  • Creator Agreement (for creators only)
1.4

If there is a conflict between these Terms and a policy above, the more specific policy applies to that subject.

2. Eligibility and accounts

2.1

You must be at least 18 years old to create an account or place an order. If you are between 13 and 17, you may use the Platform only with the involvement and consent of a parent or guardian, who is responsible for your use. The Platform is not intended for children under 13.

2.2

In Phase 1, the Platform serves buyers with a delivery address in Singapore and creators based in Singapore.

2.3

You agree to give accurate, current and complete information when you register, and to keep it up to date. We may suspend accounts with false or misleading information.

2.4

You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately (Section 17) if you suspect unauthorised use. Please log out after using a shared device.

2.5

One person may hold one buyer account. Creators may hold a separate creator account for their shop.

3. How Kaimaar works

3.1

Kaimaar is a curated online marketplace. Independent creators (“Creators”) list and sell their own handmade or designed products, and buyers (“Buyers”) purchase them. Every product must have a real creator behind it: made or designed by the Creator, not resold from a catalogue.

3.2

When you buy a product, the contract of sale is between you and the Creator. Kaimaar is not the seller, and does not own, make or inspect the products listed.

3.3

Kaimaar provides the Platform, curates which Creators may sell, processes payments through our payment provider, books delivery with our courier partners, and helps resolve issues between Buyers and Creators.

3.4

Creators are responsible for their listings, including descriptions, photos, prices, quality, safety and compliance with the law. We review Creators and may remove listings, but we do not guarantee the accuracy of any listing.

4. Buying on Kaimaar

4.1

Orders. Each order is placed with one Creator. If your cart holds items from more than one Creator, you will check out separately for each. An order is confirmed when you receive our order confirmation email. A Creator may decline an order, for example if an item is no longer available, and you will be refunded in full.

4.2

Stock. All products listed are in stock and ready to ship. We do not currently offer made-to-order items, pre-orders or backorders.

4.3

Prices. Prices are in Singapore dollars and are set by the Creator. Kaimaar is not GST-registered. If a Creator is, their prices will include GST. The delivery fee is calculated at checkout from your parcel’s size, weight and delivery distance, and shown before you pay.

4.4

Payment. Payments are processed by Stripe. We do not store your full card details. By paying, you also agree to Stripe’s applicable terms.

4.5

Payment collection. Kaimaar collects payment on behalf of the Creator as their limited payment collection agent. Once you have paid Kaimaar, your payment obligation to the Creator for that order is fulfilled.

4.6

Delivery. Orders are delivered in Singapore only, by our courier partners such as Lalamove or SingPost. Pickup is not available. Delivery times shown are estimates. Please check your address carefully; we are not responsible for delays or losses caused by an incorrect address.

4.7

Risk. Risk in a product passes to you on delivery to the address you gave.

5. Cancellations, returns and refunds

5.1

Cancellations. You may cancel an order for a full refund until the Creator marks it as dispatched or the courier is booked, whichever comes first.

5.2

Faulty, wrong or not as described. If an item arrives damaged, defective, wrong, or materially different from its listing, please report it through your order page with photos within 7 days of delivery. The Creator will offer a repair, replacement or refund, and will bear the return delivery cost.

5.3

Change of mind. Returns for change of mind are at each Creator’s discretion and will be stated on the listing. Where offered, you must request the return within 7 days of delivery, return the item unused in its original packaging, and pay the return delivery cost.

5.4

Non-returnable items. Unless faulty, items that are personalised, perishable, or unsealed for hygiene reasons cannot be returned.

5.5

Refunds. Approved refunds are made to your original payment method, usually within 7 business days of approval. Your bank may take longer to show the credit.

5.6

Your legal rights. Nothing in these Terms affects your rights under the Consumer Protection (Fair Trading) Act 2003, including the “lemon law” rights for goods that do not conform to contract, or under the Sale of Goods Act 1979. Our Returns and Refunds Policy explains the process in more detail.

6. Selling on Kaimaar

6.1

Joining. Selling is by invitation or application. We decide which Creators may sell, and may decline or remove a Creator at our discretion. Creators must also accept our Creator Agreement, which sets out commission, payouts and other commercial terms.

6.2

What you may sell. You may list only products you made or designed yourself, or that your own small team made to your design. Listings must comply with our Prohibited Items Policy and the law, including product safety, labelling and consumer protection rules.

6.3

Listings. You must describe each product accurately, use your own photos, state its price and dimensions, and state your change-of-mind return policy. You must list only items you have in stock and keep stock levels up to date.

6.4

Fulfilment. You must pack each order securely at your own cost and have it ready for courier pickup within 1 business day of confirmation. Kaimaar books the courier for you.

6.5

Customer care. You must respond to Buyer messages within 1 business day and honour Section 5 on returns and refunds.

6.6

Commission and payouts. Kaimaar charges a commission on each sale, as set out in the Creator Agreement. Payouts are made through Stripe Connect, and you must complete Stripe’s identity verification and accept Stripe’s Connected Account Agreement to be paid.

6.7

Taxes. You are responsible for your own income tax, and for GST if you are registered.

6.8

Buyer data. You may use a Buyer’s personal data only to fulfil and support their order, as explained in our Privacy Policy. You must not contact Buyers to take sales off the Platform.

7. Your content and the licence you give us

7.1

“Your Content” means anything you upload or post on the Platform, including product photos, descriptions, shop profiles, reviews and messages. You keep ownership of Your Content.

7.2

You give Kaimaar a non-exclusive, royalty-free, worldwide licence to host, display, copy, resize, translate and adapt Your Content to operate the Platform and to promote Kaimaar and your shop, including in our emails, social media, search listings and advertising. We will credit Creators where practical.

7.3

This licence ends when you remove Your Content or close your account. We may keep using it in promotional materials already published, and keep archive copies as required by law.

7.4

You confirm that you own or have permission to use Your Content, and that it does not infringe anyone’s rights or break the law.

7.5

Reviews must be honest and based on your own purchase. We may remove content that breaks these Terms, but we do not review all content before it appears.

8. Acceptable use

You must not use the Platform to:

  • break any law, including Singapore laws on consumer protection, online safety, spam and personal data;
  • post content that is false, misleading, defamatory, obscene, hateful, harassing, or that promotes violence or discrimination;
  • infringe anyone’s intellectual property, privacy or other rights;
  • impersonate another person or business, or misrepresent your connection to them;
  • post fake reviews, manipulate ratings or place fake orders;
  • arrange payment or delivery outside the Platform for a sale that started on it;
  • send unsolicited marketing or spam to other users;
  • upload viruses or harmful code, or interfere with the Platform’s security or operation;
  • scrape, copy or collect data from the Platform using automated tools without our written permission; or
  • harm minors in any way.

9. Intellectual property and infringement reports

9.1

The Platform’s software, design, logos and the Kaimaar name belong to Kaimaar or our licensors. You may not copy, modify, distribute or use them without our written permission, except as the law allows.

9.2

Creators’ products, designs and photos belong to the Creators. You may not copy or reproduce them without the Creator’s permission.

9.3

If you believe a listing infringes your copyright, trademark, design or other rights, email legal@kaimaar.com with your contact details, the listing link, what right is infringed, and supporting evidence. We may remove the listing while we review it and will share your notice with the Creator so they can respond.

9.4

We are not a court and cannot decide whether infringement has occurred. We may permanently remove listings or close accounts of Creators who repeatedly infringe. Our Intellectual Property Policy sets out the full process.

10. Third-party services and links

10.1

The Platform relies on third-party services, including Stripe for payments and Lalamove and SingPost for delivery. Your use of those services may also be governed by their own terms.

10.2

The Platform may link to other websites, such as a Creator’s own site or social media. We do not control or endorse them and are not responsible for their content, products or practices.

11. Disclaimers and limitation of liability

11.1

We provide the Platform “as is” and “as available”. We aim to keep it running smoothly, but we do not guarantee it will be uninterrupted, error-free or secure at all times.

11.2

Because Creators are the sellers, they are responsible for their products. To the extent permitted by law, Kaimaar gives no warranty about the quality, safety or legality of products listed.

11.3

To the extent permitted by law, Kaimaar is not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill, arising from your use of the Platform.

11.4

To the extent permitted by law, Kaimaar’s total liability to you for any claim is limited to:

  • for Buyers, the amount you paid for the order the claim relates to, or S$100, whichever is higher; and
  • for Creators, the commission Kaimaar received from you in the 3 months before the claim arose.
11.5

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under Singapore law, including the Unfair Contract Terms Act 1977.

12. Indemnity

You agree to compensate Kaimaar for losses, claims and reasonable legal costs arising from your breach of these Terms, Your Content, or, for Creators, the products you sell. This does not apply to the extent the loss was caused by Kaimaar.

13. Suspension and termination

13.1

You may close your account at any time by contacting us. Open orders must be completed or cancelled first.

13.2

We may suspend or close your account, or remove listings or content, if you breach these Terms, if we suspect fraud or illegal activity, if required by law or an authority, or if we stop offering the Platform. Where reasonable, we will give you notice and a reason.

13.3

When an account closes, any amounts owed between you and Kaimaar remain payable, and Sections 7.3, 9, 11, 12 and 15 continue to apply.

14. Changes to these Terms and notices

14.1

We may update these Terms from time to time. We will post the new version on this page with a new “Last updated” date. For significant changes, we will give at least 14 days’ notice by email or on the Platform. Continuing to use the Platform after changes take effect means you accept them.

14.2

We may send you notices by email, on the Platform or by other reasonable means. Notices by email are treated as received on the day they are sent, unless we learn they were not delivered. You can send notices to us using the details in Section 17.

15. Governing law and disputes

15.1

These Terms are governed by the laws of Singapore.

15.2

If you have a problem with an order, please contact the Creator first through your order page. If it is not resolved, contact us and we will help both sides reach a fair outcome.

15.3

If a dispute with Kaimaar cannot be resolved informally, both sides will first try in good faith to settle it by mediation at the Singapore Mediation Centre before starting court proceedings.

15.4

Subject to Section 15.5, the courts of Singapore have exclusive jurisdiction over any dispute arising from these Terms or the Platform.

15.5

Nothing in this section stops a consumer from seeking help from the Consumers Association of Singapore (CASE) or bringing a claim in the Small Claims Tribunals.

16. General terms

16.1

Entire agreement. These Terms and the policies in Section 1.3 are the whole agreement between you and Kaimaar about the Platform.

16.2

Severability. If any part of these Terms is found invalid, the rest remains in effect.

16.3

No waiver. If we do not enforce a right straight away, we can still enforce it later.

16.4

Transfer. We may transfer our rights and obligations under these Terms to a successor business. You may not transfer yours without our written consent.

16.5

Third-party rights. No one other than you and Kaimaar has a right to enforce these Terms under the Contracts (Rights of Third Parties) Act 2001.

16.6

Electronic acceptance. You agree that accepting these Terms online is as binding as a signed contract, under the Electronic Transactions Act 2010.

16.7

Headings. Headings are for convenience only and do not affect interpretation.
